Terms & Conditions

Article 1 (Purpose)

The purpose of these terms of use is to stipulate the matters on the internet-related services (hereinafter referred to as the “Services”), such as the provision of information, etc. through this website (hereinafter referred to as “Welstory”) operated by Samsung Welstory Inc. (hereinafter referred to as the “Company”).

Article 2 (Definitions)

  • ① The following are the terms used for these terms of use.
    • 1. Welstory: this website operated by the Company.
    • 2. User: persons receiving the Services provided by the Company pursuant to these terms of use, such as being provided with information by accessing the Welstory
  • ② All, or part, of the Services of Welstory, defined in Paragraph 1, may be changed, deleted or added due to the reasons of the Company or for force majeure reasons.

Article 3 (Specification, Explanation and Amendment of the Terms of Use)

  1. ① The Company shall post these terms of use, company name, name of the representative director, address of the business offices, telephone number, facsimile, e-mail address and business registration number, etc. on the first service screen of Welstory to provide easy access for the users. Provided, the contents of the terms of use shall be displayed to the users through a connecting screen.
  2. ② The Company may amend the terms of use so long as such an act does not violate any of the relevant laws.
  3. ③ In the event that a revision is made to any provisions in these terms of use, the Company shall provide a notice of the date of their application, reasons for such a revision, as well as the current provisions, on the initial page of Welstory for a period from 7 days prior to the date of their application to the day before their application. Provided, any changes to the terms of use that are disadvantageous to the users shall be notified within at least 30 days or longer of the prior grace period. In such a case, Welstory shall clearly compare the terms prior to and post the amendment for the users to access easily.
  4. ④ When the Company amends the terms of use, such amended terms of use shall apply only to contracts executed after such an effective date, and the terms of use prior to the amendment shall apply to the contracts already executed prior to the effective date. Provided, the amended terms of use shall apply when a user who has already executed the contract sends his/her intention to be applied with the amended terms of use within the notification period of the amended terms of use pursuant to Paragraph 3 to the Company and obtains the consent of the Company.
  5. ⑤ Any matters that are not provided in these terms of use or their interpretations shall be governed by the Act on the Regulation of Terms and Conditions, and other relevant laws or commercial practices.

Article 4 (Provision of Services and Modifications)

  1. ① The Company shall perform the following jobs through Welstory. Provision of information on the company Obtain opinions of users through the voice of customers, etc.
  2. ② The Company shall not provide services through membership registration or login.
  3. ③ The Company may post various information and advertisements, etc. related to the operation of the Services on the website page or provide to the users through SMS, e-mail, etc. At such a time, the contents of the posted advertisements or communicating or transacting with the advertiser through the advertisements by the users are between the member and the advertiser only, and as such are unrelated to the Company.
  4. ④ The responsibility of retaining personal records, such as the contents of the consultation registered by the user, etc. shall be on the user. Provided, when the Company deletes the concerned contents due to changes in the services or problems with the system, etc., it shall be notified through Welstory 1 week prior to such a deletion.
  5. ⑤ The Company may add or change the jobs stipulated in Paragraph 1 when deemed necessary.

Article 5 (Suspension of Services)

  1. ① The Company may temporarily suspend the provision of service upon the occurrences of maintenance and the repair or failure of information communications equipment, such as the computer, etc. or an interruption of communications.
  2. ② The Company shall indemnify for any losses incurred by the users or a third party from the temporary suspension of service provisions due to the reasons stipulated in Paragraph 1, unless the Company proves unintentional or non-negligence of the Company.
  3. ③ When the Services cannot be provided due to the reasons of the conversion of business, abandonment of business, consolidation of companies, etc., the Company shall notify the users through the method stipulated in Article 6 and shall compensate in a suitable method when users incur any losses due to the suspension of the Services.

Article 6 (Notification to the Users)

  1. ① When the Company provides notice to the users, it may be done so through an e-mail address or other contact information provided in the bulletin of Welstory, etc.
  2. ② The Company shall post the notifications to unspecified users on Welstory for 1 week or longer.

Article 7 (Obligations of the Company)

  1. ① The Company shall not commit any activities that are prohibited by the laws and these terms of use and go against the public order and standards of decency, and shall provide services according to the stipulations of these terms of use.
  2. ② When the Company posts personal information when the users use the voice of customer, etc., the Company shall take appropriate protective measures to protect the personal information (including credit information) of the user, such as implementing a security system, etc.
  3. ③ The Company shall be responsible to indemnify any damage incurred by the users due to actions that violate the laws, such as Article 3 (Prohibition, Etc. Against Unfair Labeling or Advertising) of the Act on Fair Labeling and Advertising in relation to the products or services.
  4. ④ The Company shall not send any marketing electronic mail for profit which are not wanted by the users.

Article 8 (Obligations of the Users)

Users shall not act in the following manners as related to the use of Welstory.
Entering false information to a degree of hindering the work of the Company
Illegal use of information of others
Arbitrary distortion or changing of information posted on Welstory
Transmission or posting of information (computer program, etc.) other than the information stipulated by the Company
Infringing on intellectual property rights of the Company or third parties, such as copyrights, etc.
Actions of damaging the honor or obstructing the business of the Company or third parties
Disclosing or posting pornographic or violent message, video or recording or information against the public order and standards of decency

Article 9 (Ownership of Copyrights and Restriction on Use)

  1. ① The Company shall have the ownership of the copyrights and other intellectual property rights on the works completed by the Company.
  2. ② Users shall not use the information obtained from using Welstory for profit-making purposes or allow a third party to use through copying, transmitting, publishing, distributing, broadcasting or other methods without prior approval of the Company.

Article 10 (Conflict Resolution)

  1. ① The Company shall establish and manage a damage compensation processing organization in order to reflect the proper opinions or grievances raised by the user and to process compensation for such damage.
  2. ② The Company shall process and answer the complaints and opinions submitted by the users as quickly as possible. Provided, when quick processing is difficult due to requiring additional investigation for fact verification, etc., the Company shall immediately notify the user of the reason and the processing schedule.
  3. ③ Persons infringed on privacy, honor, etc. due to the information posted by the Company may request deletion or the entering of refuted contents through the voice of the customer or the indicated email, etc. to the Company
    . In such a case, the Company shall respond on whether to take measures and the description of the measures after a quick review on whether privacy has been infringed upon.
  4. ④ Any request for damage relief from the users as related to an electronic commerce dispute between the Company and the user may be brought before the Fair Trade Commission or mediation of a dispute resolution authority commissioned by a mayor or the governor of a province.

Article 11 (Jurisdiction and Governing Law)

  1. ① Any actions between the Company and the user shall be brought exclusively in a competent court located within the jurisdiction of the residence of the user at the time of the action, and when there is no residence of the user, it shall be brought to a district court overseeing the residences. Provided, if the user’s address or residence is unclear or resides overseas, it shall be brought to a competent court under the Civil Procedure Act.
  2. ②The laws of the Republic of Korea shall govern the electronic commerce lawsuit between the Company and the user.

Addendum

  • 1. These terms of use shall take effect from November 13, 2018.
